Translation service


1. Scope

These orders apply to all contracts between TeleDOC24 and its clients if not agreed otherwise or regulated by law. The terms and conditions of the client apply only, if they have been explicitly agreed to previously.



2. Services

a. All offers are subject to confirmation.

b. The translation will be carried out as soon as possible subject to professionalism and with utmost accurateness. The client will receive the draft of the translation according to the contract.

c. All available information and documents required for the translation have to be allocated and send to us unrequestedly (such as a client’s glossary, images, sketches, tables, abbreviations, etc.). Mistakes which result from these items not being sent to us can not be imputed to us. The respective use of a certain terminology has to be agreed explicitly to when the order is placed.

d. We reserve the right to contact the client if there are obscurities in the original text. In this case we optionally reserve the right to carry out a translation to the best of one’s knowledge, based on the kenning meaning .

e. On behalf of a quick and smooth cooperation we take we take orders on the telephone and other informal orders. Problems resulting from this are imputed to the client.

f. The client has to inform TeleDOC24 about particular ways of carrying out the translation in sufficient time (translation on media, number of copies, form of the translation etc.).



3. Delivery Time

a. The delivery time starts with the confirmation of the order, but not before the clarification of the details of the execution.

b. If we default ourselves, the client has to set an adequate additional respite. At the end of this respite, the client can step back from conclusion of the contract, if the goods have not been announced ready for collection.

c. Claims of damage from a breach of the delivery time or delivery times shall not be provided for. This does not apply, if one of our employees has caused the delay grossly negligently.

c. Events of force majeure entitle us to delay the delivery according to the duration of the obstruction and an adequate acceleration time, or to step back from the part of the contract which has not been fulfilled at the time the force majeure has occured.



4. Dispatch

If not agreed otherwise, the dispatch will be carried out by electronic mail to the client’s e-mail-address. If requested by the client, a different, e.g. normal way of dispatch can be chosen. The mailing expenses due for dispatches within Germany, or outside Germany respectively, have to be covered by the client. The dangers of the dispatch are transferred to the client with the handing over of the translation to the respective postal service.



5. Confidentiality

All texts are to be treated confidentially and are disclosed without consultation to the respective persons who are directly involved in the production of the translation. We are committed to maintain silence about all facts that become known to us in connection with completing the task for our client.



6. Claims and Responsibility

In case of the occurrence of a problem we ask for consultation to reach an amicable solution.

a. In case of differences on the quality of the remittance work delivered, there has to be granted an opportunity for amendments. The client is entitled to corrections of mistakes in the translation. A claim of correction has to be asserted in written by the client with a detailed description of the mistake within two months on receipt of the goods.

b. If the translation is evidently not fit for use even, after amendments have been made, the client has the right to receive reduction or modification. Further claims towards TeleDOC24 or its assistants are excluded. Any liability is in any case limited to the value of the respective order.

c. Further claims of the client or a regress liability in case of claims of compensation of a third party are excluded explicitly.



7. Prices and Payment Terms

a. Written translations are calculated by the number of characters of the source language without blanks. However, the basis of the calculation is a DIN A 4 sheet. Pages with less than 1500 keystrokes are calculated by their number of characters.

b. The prices per page are based on our price table.

c. The proofreading is a separate service which is priced half of the cost of the translation price.

d. Rush-orders, overtime, night- or Sunday-work require a special arrangement.

e. All price lists, offers, estimates etc. include VAT.

f. If not agreed otherwise, the fee is due with 14 days strictly net. In case of a overrun, the interests customary in banking will be charged.

g. The mentioned prices do not include the costs for outlays, material, and postal charges. These costs will be charged to the client’s account additionally.



8. Retention of Title

The translation will be owned by TELEDOC24 until all requirements are met. Until then, the client does not have a right of use.



9. Final Clause

a. In any case and to the exclusion of foreign law, only German law applies.

b. If any of the above terms are or will become void or ineffective, this will not affect the validity of the other conditions. In this case the questionable conditions are to be replaced by other conditions which in their economical intentions come closest to the conditions questioned.

c. Contractual relations will exist only between TeleDOC24 and the client and never between the client and TeleDOC24’s freelancers.
